Two Men Charged with Felony DUI

One man had three prior DUI arrests and began to cry when police stopped him, police said. In a separate incident, a man had beer and tequila bottles--which were empty--in the car. An arrest is merely an accusation, not evidence of a conviction.

 

Thaddeus Augustyn, 67, of Niles, was charged with a felony count of Aggravated DUI after police stopped him Jan. 27 at 3:30 a.m. in the 8700 block of Cumberland. Police observed him driving without headlights on Milwaukee Avenue, folllowed him and saw him cross over the center line multiple times, according to the report.  

After police stopped Augustyn, he began crying and saying he did not have a driver's license, the report indicated, and a check of a state database showed his license had been revoked for three prior DUI arrests.  Augustyn also said he couldn't find proof of insurance, but the officer observed an expired insurance card in the car's center console, police said.

He showed impairment on field sobriety tests, the report indicated. His court date was Feb. 1.

Juan Ortega-Chavarria, 30, of Wheeling, was charged with a Class 4 Felony count of DUI, as well as driving without a valid driver's license, after police stopped him Jan. 27 just after 2:20 a.m.

Police said they observed a Dodge Caravan with Tennessee license plates traveling 54 mph in a 35 mph zone in he 9100 block of Milwaukee Avenue, followed the vehicle and stopped it in the 7900 block of Dempster. The driver produced a Mexican ID card but said he did not have a driver's license, according to the report. 

Police noticed an odor of alcohol on his breath, and he admitted drinking three beers, the report said. Officers saw two beer bottles and one small (375 ml) tequila bottle, all empty, in the passenger compartment, they said. He showed impairment on field sobriety tests, the report indicated, and was also cited for speeding and illegal transportation/possession of alcoholic beverages. His court date was Feb. 1 in Skokie.
